Seller terms of service

These Seller Terms (“Terms”) govern your use of Bazaarak as a merchant (“you”, “Seller”). By creating a store, completing payment onboarding, listing products, or accepting orders on bazaarak.ca, you agree to these Terms, our Privacy policy, and the payment provider terms shown during card payment setup.
1. Eligibility & account
- You must provide accurate business and contact information in Store admin and during payment onboarding.
- You are responsible for safeguarding admin credentials and all activity under your store account.
- You must be legally permitted to sell your products in the provinces, territories, and countries you ship to or serve in-store.
- You may be asked to upload legal business documentation for platform review before listing or receiving payouts.
2. Your store & listings
- You are solely responsible for product descriptions, pricing, inventory, fulfillment, and customer service.
- Listings must be truthful and must not violate Canadian law or infringe third-party rights (including counterfeits, unsafe goods, or restricted products).
- Bazaarak may remove listings or suspend stores that pose legal, fraud, safety, or trust risk.
- Manage catalog, orders, returns, and settings in Store admin (app: admin.html).
3. Orders & fulfillment
- Fulfill confirmed orders promptly and communicate shipping or pickup details to customers.
- Publish a clear return and exchange policy in Store admin → Settings. Shoppers see it on product pages and order details.
- Refunds and returns must follow your stated policies and applicable Canadian consumer protection laws.
- Do not cancel paid orders without refunding the customer when a refund is required.
4. Payments
Card payments
- Online and in-store card payments are processed by our payment partners under a sub-merchant arrangement.
- Complete payment onboarding (including bank account and identity verification) before accepting cards.
- You authorize Bazaarak to create and manage the payment activity needed to operate checkout for your store.
Other methods
- If you enable Interac e-Transfer or other offline methods, you are responsible for confirming payment and updating order status in Store admin.

5. Platform fees
- Bazaarak may charge setup fees, subscription or plan fees, per-transaction platform fees, and pass-through processing or chargeback costs as assigned to your store.
- Fees may be deducted from settlements or invoiced separately, as configured by the platform.
- Fee schedules may be updated with reasonable notice. Your live assigned rates appear on Your store fees.
6. Starter plan inactivity
Inactive means no completed shop transactions—no online or in-store orders that update the store’s last-sale activity. Signing into Store admin alone does not count as activity. New stores are typically measured from store creation or completed onboarding until the first sale, then from the last sale.
- You may receive a warning in Store admin before the deadline (often about 14 days prior, subject to platform settings).
- After deactivation, the shop is removed from public marketplace browsing until access is restored.
- To reopen, contact sellers@bazaarak.ca or upgrade to a paid plan (Pro / Pro+) if offered—paid plans are not closed under this Starter inactivity rule.
- The platform may adjust the exact day count or warning window; your administrator’s current settings control enforcement.
7. Chargebacks & disputes
- You are responsible for chargebacks and payment disputes on your sales, including associated processor and platform fees.
- Cooperate promptly with evidence requests for disputes and fraud investigations.
8. Taxes (GST/HST/QST and more)
You are responsible for determining, collecting, and remitting applicable taxes on your sales—including GST, HST, QST, and provincial sales tax where they apply—unless Bazaarak expressly agrees otherwise in writing. Configure tax settings carefully in Store admin. Platform subscription or service fees charged by Bazaarak may themselves be taxable; invoices or statements will reflect what we charge.
9. Marketing & CASL
If you send commercial electronic messages (email, SMS, or similar) to customers, you must comply with Canada’s Anti-Spam Legislation (CASL), including consent, identification, and unsubscribe requirements. Do not use Bazaarak order data for marketing unless you have a lawful basis and required consent.
10. Prohibited conduct & misuse
- Fraud, misrepresentation, or manipulation of reviews or orders.
- Processing transactions unrelated to legitimate store sales.
- Attempting to bypass platform fees or payment systems.
- Selling illegal, recalled, or otherwise prohibited goods under Canadian law.
- Harassment of customers, other sellers, or Bazaarak staff.
- Misuse of customer personal information.
- Abuse of the platform (fake listings, spam, inventory or ranking manipulation, or using Bazaarak to threaten or coerce customers).
Misuse may result in suspension, termination, withholding of payouts where permitted, and reports to payment partners or authorities. Enforcement by Bazaarak does not make us a party to your contracts with customers.
11. Customer disputes
You must respond promptly and in good faith to customer complaints. Where appropriate, Bazaarak may try to help both sides reach a resolution as a facilitator (for example by contacting you or sharing order context). That assistance is voluntary: we do not decide the dispute, we do not guarantee an outcome, and we do not assume liability for your products or customer claims.
12. Suspension & termination
Bazaarak may suspend or terminate your store for breach of these Terms, Starter inactivity (see §6), excessive chargebacks, legal requirements, or risk to customers or payment partners. You may request to close your store by contacting sellers@bazaarak.ca; outstanding orders and payouts must be resolved.
13. Disclaimers & liability
The marketplace tools are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Bazaarak is not liable for indirect, incidental, or consequential damages arising from your use of the Services, payment processor outages, or customer disputes about your products—including lawsuits, chargebacks, or regulatory complaints between you and a shopper. Bazaarak’s total liability for any claim under these Seller Terms is limited to the fees you paid to Bazaarak in the three months preceding the claim, unless a higher amount is required by law. This does not exclude liability that Canadian law does not allow us to limit.
14. Privacy
Customer data you receive through orders must be used only to fulfill those orders and in compliance with PIPEDA and other applicable privacy laws. Do not sell customer personal information. See our Privacy policy.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Courts of Ontario have exclusive jurisdiction over disputes arising from these Terms, subject to mandatory rules that cannot be waived.
16. Changes
We may update these Terms. Material changes will be posted on this page and, where practicable, communicated by admin notice or email. Continued use of the platform after the updated date constitutes acceptance.
Marketplace order minimums (shoppers)
Bazaarak may set platform-wide cart and per-store merchandise minimums and a small-order fee for shoppers at checkout. These rules are configured by platform administrators—not in your store Settings—and appear to customers in the cart, checkout, and Terms. They do not change your plan fees described elsewhere.
