These Terms of Use (“Terms”) govern your access to and use of the Bazaarak marketplace at bazaarak.ca, including our website, signed-in account features, and related services (collectively, the “Services”). By browsing, creating an account, or placing an order, you agree to these Terms and our Privacy policy.
1. Who we are
Bazaarak is a Canadian online marketplace operated at bazaarak.ca. We provide the platform that lets independent stores (“Sellers”) list products and let customers (“you”) browse, checkout, and track orders. Sellers set their own prices, taxes where applicable, shipping or pickup options, and return policies.
2. Eligibility & accounts
- You must be at least 18 years of age (or the age of majority in your province or territory, if higher) to create an account or place orders.
- Keep your login credentials confidential. You are responsible for activity under your account.
- Provide accurate contact, shipping, and payment information at checkout.
- You may only use the Services for lawful personal or household shopping, or other uses we expressly allow.
3. Orders, pricing & payment
- Prices, applicable taxes, shipping or pickup fees, and availability are set by each Seller and shown before you confirm payment.
- Amounts are generally displayed in Canadian dollars (CAD) unless a store indicates otherwise.
- Bazaarak may apply a small-order fee when your cart merchandise total (after discounts, before tax and shipping) is below the marketplace cart minimum, or when merchandise from any store in your cart is below the per-store minimum. Current defaults are typically CAD $30 cart / CAD $15 per store, with a single CAD $5 fee if either threshold is missed—exact amounts are shown in your cart and at checkout and may be updated by platform administrators. You can avoid the fee by adding more items.
- Card payments are processed by our payment partners. By paying, you also agree to any processor terms presented at checkout.
- Some stores may offer other methods (for example Interac e-Transfer). Those methods are between you and the Seller once instructions are shown.
- We may cancel or refuse orders that appear fraudulent, erroneous, or in violation of these Terms.
4. Shipping, returns & exchanges
Each store sets its own return and exchange policy. Bazaarak does not impose a single marketplace-wide return window. Before you buy, check the product page for the store’s policy. After purchase, your order details and confirmation also show that store’s policy and contact email.

- Nothing in these Terms limits rights you may have under applicable Canadian consumer protection laws that cannot be waived by contract.
5. Prohibited conduct & misuse
You agree not to misuse or abuse the Services. Without limitation, you must not:
- Use the Services for unlawful purposes or to buy goods that are illegal to purchase or possess in Canada.
- Interfere with site security, scrape data without permission, or harass Sellers or other users.
- Submit false reviews, abuse chargebacks in bad faith, or commit payment fraud.
- Circumvent fees or policies by taking Sellers you met on Bazaarak off-platform when that is prohibited.
- Create fake accounts, manipulate rankings or inventory, spam, or otherwise abuse marketplace tools.
- Attempt to hold Bazaarak responsible as a party to a private dispute with a Seller that you have not first tried to resolve with that Seller.
We may investigate misuse, suspend or terminate accounts, remove content, and cooperate with payment partners or law enforcement where appropriate. That does not make Bazaarak a party to your purchase contract with a Seller.
6. Intellectual property
Bazaarak’s name, logos, software, and site design are protected. Seller listings and product images remain the property of their respective owners. Do not copy or reuse content without permission.
7. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. Bazaarak does not guarantee that every listing is accurate, that every Seller will perform, or that the Services will be uninterrupted. Product descriptions, quality, and any warranties for goods come from the Seller that sold them—not from Bazaarak as marketplace operator.
8. Limitation of liability
To the maximum extent permitted by applicable law, Bazaarak and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of the Services or from purchases from Sellers. Our total liability for claims relating to the Services is limited to the greater of (a) amounts you paid to Bazaarak for platform fees (if any) in the twelve months before the claim, or (b) one hundred Canadian dollars (CAD $100), except where liability cannot be limited by law. This does not exclude liability for fraud, gross negligence, or other liability that Canadian law does not allow us to limit.
9. Disputes between shoppers and Sellers
Contact the Seller first using the details on your order. If you still need help, email support@bazaarak.ca with your order number. Where we can, we will try to help you and the store reach a resolution as a facilitator—for example by sharing information, suggesting next steps, or asking the store to respond.
- Any help we provide is voluntary and does not create a duty to mediate, decide the dispute, or guarantee an outcome.
- We do not act as your lawyer, the Seller’s lawyer, or a court.
- We are not liable for losses arising from Seller performance, product quality, delivery, refunds, or unresolved private disputes, except where Canadian law does not allow us to limit that liability.
- Nothing in this section limits rights you may have against the Seller under consumer protection laws.

10. Changes & termination
We may update these Terms or suspend access for violations. Material changes will be posted on this page with an updated date. Continued use after changes are posted constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law rules. You agree that the courts of Ontario have exclusive jurisdiction over disputes arising from these Terms or the Services, subject to any mandatory consumer protections that apply in your province or territory.
